It’s fascinating to watch him argue multiple lines of defense at once. He’s consistently questioning the murder evidence itself while also arguing her psychosis so he can speak to jury members who may be going in different directions. He’s very careful with his words and never stipulates to any exact facts when he discusses Lindsay’s actions. It’s all about problem evidence and proving her lack of capacity as both a suspect and a narrator. Every point has an asterisk of doubt. It’s incredible and I can’t see how they could possibly render a straight guilty verdict after this trial.

How do you think the jury will look at him if he pivots away from “she did it but is not responsible” to we don’t know who is responsible because the police work was shoddy? If I were on that jury I would lose all trust. Like why spend 20 days admitting she killed the kids only to change at the 11th hour

I kind of felt like he went with the safe route of arguing not criminally responsible because arguing outright not guilty rests on the prosecution putting on a clear story. He knew they were going to be a mess and went with not criminally responsible because then he can take control of the story without taking on the burned. But then seeing truly how bad of a job they did putting on any evidence that she did it, it’s impossible to not at least point that out a little. But that’s the hog tied issue he talked about. You don’t want to confuse the jury on what your argument is and have them not believe either arguments and end up at guilty.

This is so interesting. In the UK, prosecution and defence have to complete a 'Preparing for Effective Trial' document where both sides have to set out the evidence agreed, and set out what the trial issues will be, what legal arguments they will be relying on and what witnesses they will be calling. Evidence can't be sprung on either side during trial so both sides can adequately prepare and confirm their position. It's always fascinating to see how courts work in different countries.

He will do whatever it takes to protect Lindsay, and he’s done just that. I have no doubt that he wants Patty to face consequences if for nothing other than negligence, but that’s not his job. His job is to defend Lindsay. He did that perfectly.

I kept waiting for him to jump in—asking about why Callan was resuscitated, her temperature being what it was, were her wounds possible from someone else etc I was surprised he didn’t question some of these things (if he felt these were issues) just to name a few things

I’m not even sure it would benefit her to bring it up even with hard evidence. The system is working exactly as intended and people that think there’s some sort of “right and just” conclusion to this haven’t been listening to victims and think a lot of people’s worldviews are going to continue to shift when they realize how not fair our system is
