I get the feeling, and this could be inaccurate, but my perception is that they refused to agree to the bifurcation because they knew they did not have a solid enough case to prove beyond a reasonable doubt for the guilty verdict alone. They have relied heavily on proving her to not be in a compromised mental state rather than proving her to have done it. If they act as if they've conceded to being involved, while the still have that burden, it is muddled by the idea of the criminal responsibility portion.

Good explanation. I think this case should prove that when a defendant is going for an insanity please, the case should be bifurcated.

I feel like the judge adding manslaughter as an option is completely unfair. It just seems like a way for the prosecution to avoid looking terrible and the jury gets an easier way out.

The prosecution in closing inferences to the jurors that Lindsay is sane due to requesting an attorney which has been grounds for cases in the Supreme Court to be overturned in Massachusetts including murder convictions. It can not be inferred that a defendant is guilty or sane due because they use their constitutional rights to request an attorney. The conduct of this prosecution has been horrid.

I wonder if the jury notices that Patrick hasn’t been in the courtroom since he testified. Personally I would be wondering that. However people view him, it is very telling that he’s just out and about town while his CHILDRENS MURDER TRIAL is happening.

Do you think Reddington was banking on the bifurcation and/or thr Bowden charge being granted and his plan he saw playing out blew up? Or do you always assume those requests will be denied?

How can they decide if she committed the crime when Reddington is saying she did

Hi! I sent you a question that I don’t want to ask publicly about the trial in a DM if you happen to have time to read it! 🙈
