4. It depends.

None of these answers would suffice for law school though… way too generic and she didn’t even answer the misdemeanor vs felony question. Yes it’s different for every state as well as federally but regardless the answer should have mentioned the level of offense/punishment. Misdemeanor is on the low end vs a felony is the most serious category of crime.

I'd argue she's not right on the felony/misd question. The actual charges may vary but the substantive difference in every state is in sentencing. Misd will always be less than a year, felony is a year or longer. Other than that she basically hit everything else.

Bruh a misdo is a crime punishable up to 1 year, a felony is anything punishable over 1 year

Substantive law is a destination(do & don't) but procedural law is like the road that take you to your destination.

Perhaps the most striking difference between intentional torts and negligence is that “intentional torts” are mostly actionable per se [i.e., the claimant doesn’t prove injury or actual damages to establish liability] Examples are the battery, assault, false imprisonment etc. Negligence on the other hand is action on the case [i.e., claimant needs proof of damage to bring an action]

Felony is a crime punishable by a year or more incarceration. A misdemeanor is punishable by less than a year of incarceration (generally speaking)
