Yes, despite it being their mistake she knowingly allowed them to proceed forward understanding they had an expectation of being paid for their services - under common law she would be obligated to pay and the construction company would have the defense of promissory estoppel for contract formation.

Yes she’s supposed to notify them and then they’re supposed to either pay or fix it back to the condition. It was already in. You don’t let them continue to do all the work then you become legally responsible for paying for it.

Yes .. to a degree. This is called unjust enrichment. However, the cost is limited to very little profit. Now, if she had been off on vacation and then shows up and there is a new deck, then unjust enrichment does not apply, but the contractor cannot profit either.
