Just a correction, there is no such thing as “nonjudicial charges.” All military charges under the UCMJ are judicial. An offer of nonjudicial punishment (aka an Article 15h) is just an offer of a plea deal. If the person does not accept nonjudicial punishment, they do have to face a courts martial.
