@shanwudc: Here’s the part of the reflecting pool case that really defies logic. DOJ dismissed the case after its own evidence undermined the vandalism allegations, but prosecutors still asked for the dismissal to be without prejudice. Why does that matter? Because without prejudice means the government could potentially bring the case back. With prejudice means it is dead for good. But what exactly could change here? What new evidence is supposedly going to emerge when the government has already acknowledged that the damage was not caused by vandalism? If DOJ got this case wrong, then dismiss it with prejudice and end it. Keeping the door open to revive a case that should never have been brought raises some serious questions.
