What scares me is not one mail-in ballot rule. It is watching the guardrails of government become increasingly dependent on who currently holds power. The Constitution gives Congress authority over the postal system, and it gives states the initial authority to determine the manner of congressional elections, subject to laws passed by Congress. Yet we now have a president directing federal agencies to alter the machinery surrounding mail voting months before a national election, and a Supreme Court whose current 6–3 conservative majority includes three justices he appointed allowing that effort to proceed for now without deciding whether it is even lawful. And that is the part I refuse to normalize. If you want nationwide election rules, pass legislation. Debate it publicly. Put your name on the vote. Let the states challenge it. Let the courts review it. But changing the infrastructure of voting through executive power and then telling states they have to wait until the threat is less ‘speculative’ before they can challenge it? That should disturb people regardless of which party controls the White House. Because someday the person wielding that power will be somebody you hate.
