I do think his ultimate plan is to get NG without criminal responsibility, win the appeal which will likely happen due to the religious comments and he got Patrick’s testimony without him being guarded and able to plead the 5th and he can’t change his story now to fix the timeline because Reddington can just bring up his previous testimony. If that’s his end game it’s pretty smart. I would have preferred him go straight for the not guilty but he’s much smarter than me so he must have his reasons

This has been out for 3 years. “She’s done it” since day 1. He tried to go for a bifurcated which would have been two parts. Part 1, is she guilty. Part 2, IF found guilty, was she sane. Judge said no. That would have been the trial we wanted. Red himself said if they had it in their minds she did it without the evidence ngri is the best strategy and you basically have to say she did it to claim insanity, which is accurate because she has no reliable recollection of what happened. So it all makes sense. That’s why he pleaded that the jury looks closely at the evidence.

He only need to remind one juror that there is some reasonable doubt, that the timeline ain’t timelining, that her alleged behavior doesn’t make sense so either she was set up, or she was in a state of psychosis, that the commonwealth’s arguments are honestly just obtuse and disingenuous. Only one single juror has to dig their heels in. That’s the case he argued. He’s just looking for one. And because he’s working multiple angles, he may get more than one. He may even get all of them. But at the end of the day, he only needs one.

Reddington wanted the trial split so he could first challenge whether the Commonwealth even proved Lindsay committed the crimes, then address criminal responsibility separately. Since that was denied, he had to argue both at once. The jury can still find her straight not guilty, not guilty due to lack of criminal responsibility, or guilty of one of the homicide charges.

He was an incredible defense attorney, and still I feel so sad about the entire trial. I’ve analyze this thing to the point that I might be insane, watched literally every minute of the trial every single day, and tho I am thrilled for how well he did during the trial, I just feel…… emotional. He is not the reason I have reasonable doubt. The prosecution gets all the credit for that one! Him saying over and over she did it, is gonna be an issue that the jury is going to have a hard time looking past. In my humble opinion.

Another appeal is that the prosecution is not allowed to ever infer that a defendant is sane or guilty because they requested an attorney . It has been brought in from the Supreme Court in Massachusetts and has been used to overturn convictions including murder.

Yes. But… he drew the line on clearly delivering on his closing. The civil suit unfortunately depends on her having committed the murders, it’s a financial law suit. I’m sure she’d much rather have a chance at being free from a mental hospital instead of money which has no value to her personally if she’s locked up. This was her one chance at being free.

I don't think anyone really understands what the alternative would be. He's made the CW have to argue she was essentially fine, regardless of the records. If he just did a not guilty it was someone else, look at the inconsistencies, the CW would have BURIED her in "look how insane she was".

Very few people are saying that he missed some things, but those people that did say that actually missed the big thing in his closing that closing argument is gonna go down in history and it’s gonna be written in textbook and it’s gonna be taught in law schools, his closing argument is going to set the standard for future defense attorneys to reach that bar of excellence. It was masterful it was patient it was like we don’t have to get frustrated and hyped like the prosecution. We have all the evidence the truth is on our side and he just kind of sat back and presented it in the most digestible way possible it was incredible and then I played it for my husband last night and he was like wow and he never watches this stuff at all but now he’s pulled into this too.
