Everyone saying the older one needed the new ds is wrong. Both kids were fighting and only one ds was broken. He had no ds for 3-4 weeks. That was definitely punishment enough. Also why give new ds to brother? That means no toy for him. How is that fair to the 8 year old?

YTA. The obvious solution is to buy older kid a new DS right away, take away the younger kids DS until his birthday as punishment and then get him games or whatever else on his birthday. Getting the younger kid a new DS for his birthday doesn’t make sense at all 😭😭

People keep forgetting the younger brother wasn't rewarded for breaking the DS. Imagine if they had two apples and younger brother ate thr older brother’s apple. The younger brother now has to hand over his apple and he has none. For his birthday he wanted to get a banana but instead he got an apple. They both had apples by the end.

I would make sure that the older kid gets the new DS. Birthday kid keeps his original. As a mom of 5, younger brother hasn't learned anything. I wouldn't allow him to get a DS for his birthday either, that would be a maybe Christmas present.

The story is framed as if one boy made a mistake and then suddenly he has a better DS than his brother, but that framing was created because the situation felt unfair, not because it was accurate.

yeah it's funny how so many parents are like oh if it was malicious it would have changed the outcome. depends what people consider to be malicious. everything my brother ever broke of mine, he'd say he didn't mean to and my parents wouldn't punish him, or replace the thing he broke cuz "it was an accident" except my brother LOVES to take things apart and is very rough with everything he touches. so even if his intentions weren't to break it beyond repair, the act of taking it apart or pulling on it in the opposite direction or whatever, was intentional and it always drove me nuts he just kept being allowed to do it. even as an adult now, he broke my switch controller and he didn't replace it, he sees nothing wrong with what he did because "it was an accident". in OPs case it does sound like a genuine accident but at what point does a parent see accident vs intent? I'm curious coming from a childhood in which my brother could do no wrong

The younger brother would not have gotten a new DS if he never had to give his older brother the DS on account of breaking the older brother’s original console. If the younger brother did get a better one its likely the only reason that he felt compelled to ask for a newer or better one is because he no longer had one. I think the younger brothers DS should’ve been taken away as a punishment for a period of time decided by the parents and then the older brother should’ve been bought a new one.

The brother should’ve not gotten a birthday present and been told it’s to replace his brothers DS that he broke. He wasn’t really punished since it was only a few weeks without his DS and the brothers was an old one.

I think that the punishment should have been that the younger brother give up his DS to the older brother until his birthday and when the birthday came around the Older brother should have gotten a new one and the youngest got his old one back.

The one who broke the DS should have been grounded from his DS for a week or so; maybe even until his birthday, and the one whose DS was broken should have gotten a new DS.

he got in a fight with his brother, which is very normal behavior for that age, and took responsibility for it. He didn't deserve to have his whole birthday ruined over it. that's how you teach him to never take ownership for his mistakes ever again.

I feel like some people just really wanted this kid to suffer more than he did. Like just because our parents gave us ridiculous, harsh punishments, doesn’t mean others should get them. No DS for a month, plus his brother having his and rubbing it in his face, is a good enough punishment. Ruining his birthday after that just seems unnecessarily cruel. And his brother also got a new one just a few months later. It all worked out fine.

Remaining DS confiscated immediately. Little bother should have had to pay for older brother’s new DS with his birthday money. Little brother would only receive his old DS back upon completion of paying for older brother’s DS. Dad for sure rewarded little brother for bad behavior.
