@drkathynickerson: The jury has gone home for the weekend without reaching a verdict in the Lindsay Clancy case, and based on my experience, the longer jury deliberations go on, the more I think we are headed toward a mistrial. A mistrial could be very difficult for Lindsay and her family for several reasons. First, putting on a defense like this is extraordinarily expensive. Expert witnesses, attorneys, preparation, records review, and weeks of trial can cost hundreds of thousands of dollars. That raises a much bigger concern about fairness in our justice system. Very few families can afford a defense of this magnitude, and access to resources can dramatically affect someone’s ability to mount a comprehensive defense. Second, if there is a mistrial and the DA chooses to retry the case, the prosecution gets an enormous advantage: they have now seen the entire defense. They know which witnesses were persuasive, where their own case was vulnerable, what arguments the defense emphasized, and what they might want to do differently next time. They could potentially come back with a much more formidable case. None of this means we know the jury is deadlocked. We don’t know what’s happening in that room. But as the deliberations continue, I become increasingly curious about whether there is a fundamental disagreement among these jurors that they simply cannot resolve. As a lawyer and former prosecutor I think it’s WAY too premature to think this is going towards a mistrial. They have basically had one full day of deliberation for a very complex and emotionally charged and high profile case. I think it’s late Monday/Tuesday before they would even indicate that they are at an impasse, at which point they are given the Allen charge. I don’t think the judge allows them to hang before Wednesday. Also, being out longer is generally better for defense.

We all want justice for the children. I just believe the right person needs to be held accountable. The investigators failed the children. The medical examiner failed with the children. The Commonwealth failed the children by not having a good enough case. If we’re all about getting justice for the children. Then we should be mad at the people who didn’t gather enough evidence. Or was there just not enough evidence to gather to blame it on her? There was enough evidence in my mind that beyond a reasonable doubt that she did this she should pay for it. But the investigators and the district attorney attorneys failed to show beyond a reasonable doubt. That’s their failure. The jury cannot be using emotions on this one and honestly, they’re not supposed to do it on any case. There are not enough facts to say she did this beyond a reasonable doubt. And that’s without even bringing up the Patrick situation.

It’s a choice by the commonwealth— there NO away in HELL they would put such a shifty shoddy investigation on again. The investigation is done - it was awful. The thing is, there are so many, highly qualified and professionally licensed people following this case. I really do truly believe that within the next few years, somebody is going to crack the code and prove the rightful people responsible for the crime. Also, these people are from the outskirts of Boston, chances are high that they are going to be majority liberal as well as more emotionally, intelligent than the average American. But, I could be completely wrong and I am definitely still in agreement with you all the way I’m seeing what you’re seeing at the same time. There are many people that are either narcissistic themselves or they are blind to narcissist, red flags, especially when they are covert
