In May 2021, my colleagues and I passed a law to reform the structure of the WAPA board in the Virgin Islands, aiming to improve its service to the public. However, the Governor challenged our authority to make these changes, claiming that the Revised Organic Act granted him sole control over such boards. To me, it was clear that if the Legislature has the authority to create a board, this authority does not simply vanish once the board is established. Despite this, the Governor sued to prevent the Legislature's reforms to both the health board and the WAPA board, ultimately winning in the first case and setting a troubling precedent that undermined legislative powers. The following year, we continued efforts to update the WAPA board's structure to enhance its effectiveness, but again, the Governor resisted, asserting his sole control. I actively urged my fellow senators and legal advisors to recognize this overreach, believing it essential to preserve the Legislature's authority. When the Governor filed another lawsuit, the Superior Court ruled in our favor, affirming our legislative power to amend laws, including those governing boards. The Governor appealed to the Supreme Court, which ultimately sided with us, reinforcing our legislative rights as provided by the Revised Organic Act.
