Another note from the Lindsay Clancy jury — and Judge Sullivan’s response was very pointed. He brought the jurors back in and emphasized that their job is to deliberate based on the legal instructions HE gave them — not anyone else’s interpretation of the law, not outside commentary, and not their own rewritten version of the standard. And he specifically brought them back to reasonable doubt. That matters because this jury has now been deliberating for roughly 35 hours over six days, has already reported being deadlocked twice, and received the Tuey-Rodriguez “dynamite” instruction yesterday. So hearing Judge Sullivan put the emphasis back on his instructions caught my attention immediately. At this stage, the jury is not being asked to invent a standard they can all agree on. They are being asked to apply the law exactly as the judge instructed them — including the Commonwealth’s burden and the meaning of reasonable doubt. Day 6, and this jury is still working through it.
