For 17 years, Aliya Mohamed worked as a migrant worker in the Middle East, far from her birthplace in Arsi Zone. Like many Ethiopian migrant workers, Aliya left home with a dream: to work hard, support her family and eventually return home with enough resources to build a better future. Her years abroad were not only about earning an income. She carried the responsibilities of supporting her two children and helping care for her mother in Ethiopia. Much of what she earned through years of migrant labour was directed toward her family and toward building a future in her community. In 2018, Aliya began constructing a three-storey building in her birthplace of Bale Gasgar. The building represented the savings, sacrifices and hopes accumulated during 17 years of work abroad. For Aliya, it was more than a building. It was the result of years of separation from her family, difficult working conditions and financial sacrifice. It was also an attempt to return home and contribute to local economic and community development. But in 2026, after years of investment and construction, Aliya says the Bale Gasgar city administration instructed her to demolish the building. The decision has left her facing the possible loss of an investment built from 17 years of migrant labour. The case raises a broader question: When an Ethiopian migrant returns home after years of working abroad and invests her savings in her community, what protection does Ethiopian law provide if local authorities order the demolition of her property? What does Ethiopian law say? The Ethiopian Constitution protects the right to private property. Article 40(1) provides that Ethiopian citizens have the right to ownership of private property, including the right to acquire, use and dispose of property in accordance with the law. Article 40(7) also protects the rights of Ethiopians to immovable property that they build. (Servat) At the same time, Ethiopian law does not provide an unrestricted right to construct a building. Urban land is generally held under a lease system, and construction must comply with applicable land-use, planning and building requirements. Ethiopia’s Urban Lands Lease Holding Proclamation No. 721/2011 remains listed by the Ministry of Justice as in force. (Justice Ethiopia) Ethiopia also enacted the Building Proclamation No. 1356/2024, which regulates building construction and is intended to ensure compliance with building codes, public health and safety requirements and proper construction standards. (Justice Ethiopia) Constitutional protection against uncompensated taking Article 40(8) of the Ethiopian Constitution states that the government may expropriate private property for a public purpose, but it must provide compensation in advance and commensurate with the value of the property. (Servat) Ethiopia’s expropriation legislation is also based on the constitutional requirement of advance compensation when private property is expropriated for public purposes. (Justice Ethiopia) This means that if Aliya’s building is being taken or demolished as part of a lawful public-purpose expropriation, the authorities cannot simply ignore her financial interest in the property. However, there is an important distinction: if the building is being ordered demolished because it was illegally constructed, lacks required permits, violates an approved plan, or presents a serious safety problem, the compensation analysis may be different. The exact facts and documents therefore matter greatly. Does her migrant-worker status give her additional protection? Aliya’s 17 years working abroad are extremely important from a social and development perspective, but they do not automatically create a special exemption from Ethiopian construction law. Nevertheless, Ethiopia has recognized the importance of migrant workers, returnees and diaspora investment in national development.
