@kara_marlene: I need people to hear this EXACTLY as the judge said it. Not paraphrased. Not filtered through TikTok. Not through me. Not through somebody in the comments. Straight from the judge: “Commonwealth bears the burden of proving beyond a reasonable doubt that the defendant committed the crime of which she is charged AND ALSO that the defendant is criminally responsible for her conduct.” Read that again. AND ALSO. I keep seeing people say: “She’s already guilty.” “She admitted it.” “The only thing this trial is deciding is criminal responsibility.” That is NOT what the judge told this jury. The Commonwealth has the burden of proving beyond a reasonable doubt: that she committed the charged crime AND ALSO that she was criminally responsible for her conduct. Both. Lindsay enters this case with the presumption of innocence. An indictment is not proof. An accusation is not proof. A statement is not automatically the end of the analysis. And the defense does not carry the burden of proving her innocent. So when people tell me: “We already know she’s guilty. This trial is only about insanity.” No. Listen to the judge. He could not have said it more clearly. The Commonwealth must prove BOTH beyond a reasonable doubt. That is not my opinion. That is the instruction governing this jury.
