Because we did not lowered the 2/3, it’s still 2/3,” Tulfo said during a press conference. Tulfo was referring to the impeachment court’s 13-1 vote Wednesday overturning the earlier ruling that fixed the conviction threshold at 16 votes, or two-thirds of the full 24-member Senate. Under the new ruling, the two-thirds requirement will instead be computed based on senator-judges who remain legally and factually capable of participating when the final judgment is made. The ruling does not set a new fixed number of votes needed to convict Duterte. The court will determine which senator-judges may be excluded from the count before the final vote, with any fraction in the two-thirds calculation rounded up. Tulfo’s appeal was supported by 12 other senator-judges, while Presiding Officer Francis Escudero cast the lone dissenting vote.
