Jurors in the civil wrongful death trial over a crash that killed two young brothers in a crosswalk near Westlake Village, California, saw texts on Monday between the driver and her boyfriend who was speeding near her when she hit the boys. Scott Erickson is a defendant in the lawsuit along with his ex-girlfriend, Rebecca Grossman, who is in prison for second-degree murder, and her husband, Peter Grossman, because his wife's SUV was registered in his name. Erickson, a retired Major League Baseball pitcher, says he wasn't speeding excessively or impaired. Attorney Brian Panish, who represents the parents of Mark and Jacob Iskander, questioned Erickson about his communications with Grossman after the crash, including messages that Erickson deleted before attorneys obtained his texts through the discovery process. Panish highlighted messages Grossman sent Erickson that, in the discovery, don't have replies.

"You understand that text messages are evidence in this case?" Panish asked. "Yes," Erickson answered. "And you understand you have an obligation to preserve evidence for a case?" Panish asked. Judge Huey Cotton overruled a foundational objection and Erickson answered, "I was not aware at the time." "So you're not aware that you're to preserve evidence when you were deleting messages with Rebecca Grossman, correct?" Panish asked. "Correct," Erickson answered. "You just thought it was okay to do that?" Panish asked. Erickson answered "yes" and Panish asked, "You're unaware of the consequences under the law of doing that, correct?" "No, I was not," Erickson answered. "You don't think there's any consequences?" Panish asked. "No, I didn't know," Erickson answered. "If you knew that you're not supposed to do it, you wouldn't have deleted them, would you?" Panish asked. "Correct," Erickson answered. You can watch all of Erickson's testimony from Monday on my YouTube channel. He'll continue testifying today (Tuesday, May 12). #law #driving #court
