@anas.al.albani: Educational information Sarkhasi Al-Hanafi said, وإذا كان قوم من المسلمين مستأمنين في دار الحرب فأغار على تلك الدار قوم من أهل الحرب لم يحل لهؤلاء المسلمين أن يقاتلوهم؛ لأن في القتال تعريض النفس فلا يحل ذلك إلا على وجه إعلاء كلمة الله عز وجل وإعزاز الدين، وذلك لا يوجد ههنا؛ لأن أحكام أهل الشرك غالبة فيهم فلا يستطيع المسلمون أن يحكموا بأحكام أهل الإسلام، فكان قتالهم في الصورة لإعلاء كلمة الشرك، وذلك لا يحل إلا أن يخافوا على أنفسهم من أولئك، فحينئذ لا بأس بأن يقاتلوهم للدفع عن أنفسهم، لا لإعلاء كلمة الشرك “If a group of Muslims are under a pledge of security (amān) in the Dār Al-Hārb, and a group of the people of (another) harbis attacks that territory, it is not permissible for these Muslims to do Qital against them, because Qital exposes one’s life to danger, and that is not permissible except for the purpose of raising the Word of Allah, Mighty and Exalted, and strengthening the religion. That purpose does not exist here (in Dār Al-Kufr), because the laws of the Muhsrikeen firmly established over them, and the Muslims are unable to enforce the laws of the Islam. Thus, their Qital, outwardly, would be for raising the word of Shirk, and that is not permissible. This is unless they fear for their own lives from those attackers. In that case, there is no harm in Qitāl them in order to defend themselves—not to raise the word of Shirk." 📕 Al-Māsbut 10/98 He calls their Lāws as Lāws of Kufr and Word of Shirk, does anyone has any doubt Fuqahah consdiered Lāws of Mushrikeen to be Major Kufr and Shirk ? From Imam Shāybani and Qādi Abu Yusuf, وعن أبي يوسف ومحمد رحمهما الله تعالى إذا أظهروا أحكام الشرك فيها فقد صارت دارهم دار حرب؛ لأن البقعة إنما تنسب إلينا أو إليهم باعتبار القوة والغلبة، فكل موضع ظهر فيه حكم الشرك فالقوة في ذلك الموضع للمشركين فكانت دار حرب، وكل موضع كان الظاهر فيه حكم الإسلام فالقوة فيه للمسلمين. “And it is narrated from Abū Yūsuf and Muḥammad, may Allah have mercy upon them: If they manifest the laws of shirk therein, then it has become their Dār al-Ḥarb. This is because a territory is attributed to us or to them according to power and dominance. Thus, wherever the rule of shirk is manifest, power in that place belongs to the polytheists, and so it is Dār al-Ḥarb. And wherever the rule of Islam is predominant, power therein belongs to the Muslims.” 📕 Al-Māsbut 10/114 If Lāws of Kuffār are laws of Shirk, than it is Shirk for whoever implements it Imām ibn Abdil-Barr Al-Maliki “And it is impossible that they could be a group of believers, all of them dividing their inheritance according to the Sharīʿah of the Ṭāghūt and the Minhāj of kufr. This is has been said by Ibn Shihāb (Zuhri), a group of the people of the Ḥijāz, and the majority of the people of knowledge and ḥadīth.” 📕 At-Tamheed 50/2 He refers to Lāws of Yahud, Nasarah and Majus as Shari‘ah of Taghūt, how about one who creates his own Shari‘ah is he not a Taghūt ?
