My 7th great-grandfather was hanged for treason for choosing the King in the Revolutionary War, and from where he sat, it was the rational choice. James Lindley was a justice of the peace and a militia captain in the South Carolina backcountry. His land came under a royal seal. So did his office. When a neighbor needed a land sale acknowledged, the law arrived in his person, and the law was the King's. Everything he was had a crown stamped on it. To see why he staked his life on George III, look at the alternative: Charleston. South Carolina in the 1760s ran as two countries under one charter. The lowcountry coast held the wealth, the assembly, and the courts. The interior held tens of thousands of settlers and almost nothing: no court, no jail, and no resident sheriff until 1769. A man robbed on the Saluda had to haul his case a week's ride to the coast. When the backcountry organized into Regulators and demanded law and order, it was the Crown that answered, not South Carolina. The Circuit Court Act of 1769 brought the interior its judicial districts and officers of the peace, and Lindley's commission came through that same wave. In living memory, the government that had finally brought order wore a royal cipher, and the men who had withheld it sat in Charleston. So when those same Charleston gentlemen began in 1775 to talk of liberty and demand the interior fight the King, it looked like a trade of a distant king for a much nearer and less responsive aristocracy. 118 men in Lindley's company signed for the King. The rebellion could only subtract from his life. The Whigs caught him twice. In 1775 they cornered his Loyalists at the Great Cane Brake and released him on his word never to fight again. He fought again. In 1779 a Loyalist column he rode with, marching to join the British army in Georgia, was ambushed at Kettle Creek, and he was imprisoned in the brick jail at Ninety Six. The British command demanded that the captured men be held as prisoners of war; South Carolina tried them as traitors anyway. Roughly 50 were convicted. Five hanged. He was one of them. Every man who condemned him had sworn the same oath to the same King and broken it. Lindley kept his. The winners took the country, and with it the right to call him a traitor. The act that word covers is loyalty. His crime was refusing to change his mind, and the country changed around him instead.
