I’ll save yall time because there’s no part 2. Case is dismissed. California Labor Law protected the defendant. The plaintiffs did not have overpayment plan in writing signed by both parties as required by CA state law

Do pay stubs not exist? Just because he gets direct deposit doesn’t mean he couldn’t see he was getting over paid… be so for real…

For those that don’t want to find the outcome, case was dismissed. CA labor code protected the man from needing to pay back the company, since the company stupidly didn’t have a formal agreement. Instead they just started deducting it from his paycheck (lowkey illegally).

If there was an email with an agreement, why would you not bring that to court. If you deduct money from someone’s check how do you not have a record of it.

Proper order… the employer never even consulted a lawyer or legal expert, law is clear in California… unless a written agreement is there , they cannot deduct… end of

Are company did that to us to our restaurant at 1 time? They make the mistake and some of the employees have already used the money. So they started deducting them from their check. I saved mine because I knew it was not the right amount. So I paid it all back. They took it directly out of our direct deposits wish I think it was wrong because some of these kids couldn't afford to pay it back. If you make the mistake you deal with the mistake just because you're rich companies doesn't mean you take advantage of your workers. And that's where my company did
