I think saying that a not-guilty verdict in the Lindsay Clancy case would somehow lead to women losing their rights is a huge leap. Courts are supposed to look at the individual defendant, the specific evidence, expert testimony, and the legal standard in that case. The defense and prosecution have introduced hundreds of pieces of evidence that most people commenting online have never actually reviewed. We’ve dealt with difficult cases like this before. Andrea Yates was found not guilty by reason of insanity after killing her five children while suffering from severe postpartum psychosis. That did not result in society deciding that women were “too hormonal” to vote, hold office, become president, or make their own decisions. John Hinckley Jr. was also found not guilty by reason of insanity after shooting President Reagan. Nobody concluded that everyone with a mental illness should automatically lose their constitutional rights. And look at civil-rights history. When cases like Brown v. Board of Education or Loving v. Virginia changed rights on a broad scale, they did so because the Supreme Court specifically ruled that certain laws were unconstitutional. That is completely different from a jury deciding whether ONE defendant was legally responsible for ONE set of crimes. We even see this same exaggeration around Trump’s court cases. Depending on which side you’re listening to, one ruling supposedly means “democracy is over,” while another supposedly means presidents can suddenly do whatever they want. The actual legal consequences are much narrower and depend on exactly what the court ruled. You can believe Lindsay Clancy should be held responsible and still understand that an insanity verdict would not automatically create some legal precedent declaring women incapable of controlling themselves. This case should be argued on its evidence, not on hypothetical consequences people are attaching to it.
