excessive? A grown man slaps him across the face and he retaliates with a punch. That's a fair fight. If you factor in the weight. The waiter is actually at a disadvantage.

Judge erred in the ruling because it was purely retaliatory self defence. Restaurant worker was not armed and his reaction was instinctive, neither excessive nor intentional. Customer's death was accidental.
