Cornell law degree here and former MP here. This is such a lie. it was a meme for awhile, but it would not work. a blood test will tell you were already intoxicated, and police now have the ability to estimate your blood alcohol content at the time you were pulled over - which had been upheld in court.

I’m pretty sure a cop can physically prevent you from interfering with an investigation. So essentially if the officer understands what he’s allowed to do he can stop you.
