@cbsnews: On Tuesday, jurors in Lindsay Clancy’s trial told Plymouth Superior Court Judge William Sullivan that they were unable to reach a unanimous verdict. According to Massachusetts law, if the jury remains deadlocked, Judge Sullivan will meet with attorneys for both sides before reading the jury what are known as the “Tuey-Rodriguez” instructions. The state-specific instructions were also given during the 2024 trial of Karen Read in Massachusetts. If jurors remain deadlocked a third time, Judge Sullivan will declare a mistrial. If Clancy is convicted of first-degree murder, second-degree murder or manslaughter, she will be sentenced to prison. If jurors find her not guilty by reason of insanity, she will remain at Tewksbury State Hospital, where her case will be reviewed periodically.

Shouldn’t the trial have come after PROVING WITHOUT REASONABLE DOUBT SHE committed the crime?

That’s how most states and federal courts handle deadlock juries. The Rodriguez charge just may be called something else like the Allen charge in federal trials.

it’s odd they don’t support a majority ruling in such circumstances. i.e if there are 12 jurors the judge would accept a majority verdict of 10 etc

A deadlocked jury should equal innocent. Clearly there are people on that jury who believe she is not guilty of these crimes and that should be all they need to find not guilty

There is definitely a reason to suppose that ‘more or clearer evidence can be produced’ especially with such a shitty job the initial investigators did. They simply took Patrick Clancy’s word for everything and went with it.
