Michigan does not have a separate criminal statute called "incest" that prosecutes two consenting adults.
That is why the legal histories describe it as:
750.333 Repealed. 1974, Act 266, Eff. Apr. 1, 1975. Compiler's Notes: The repealed section pertained to incest.
And: Michigan repealed its criminal incest statute in its entirety. New Jersey was one of the few states to follow suit, effectively decriminalizing adult consensual incest.
What that means in Michigan:
• No prosecution under an "incest" label for two adults who both consent and are not under coercion, force, or incapacity
• Incestuous marriage is still void — you cannot marry a close relative
• All of the Criminal Sexual Conduct laws — MCL 750.520b, 750.520c, 750.520d, 750.520e — still apply. If there is force, coercion, a minor, mental incapacity, or abuse of authority, it is prosecuted as CSC, not as incest.
