The problem with this case is that there was no real investigation so the jury was given opinions rather than actual evidence. It was all hearsay.

Honestly, the Commonwealth getting the chance to retry and learn from their mistakes seems completely unfair. It’s expensive to the taxpayers, expensive to the defendant, and if they couldn’t try their case correctly, the first time then I don’t think they should be allowed to come back with the same exact charges. At the very least, I think they should be forced to downgrade to a lesser charge.

it's quite literally just forcing people to change their minds. the couple jurors that will be strong in their stances will be forced to change their minds and that's one of the many reasons why people in the United States end up going to jail for life when they are completely innocent.

My thing is.. how can you possibly find a new jury who has no idea what happened in the first trial.. the whole country knows. You wouldn’t likely find a unbiased jury

What I never understood was .. in criminal court your guilty verdict means there’s no reasonable doubt … but if a jury of 12 can’t come to an agreement … doesn’t that mean there’s reasonable doubt ?? Which would mean you can’t by law find them guilty ? .. so it doesn’t make sense to me .. can someone explain it?

I don’t appreciate the thought that jurors are being talked out of their convictions to make it more convenient- anyone with weak character will be bulldozed - it takes a person very okay with not being validated to hold strong. Shunning is a very effective tool for coercion. I have a flaw that makes me okay with it- I am 100% an anomaly. The only people who can hold out are either contrarians- or exist independent of community validation at baseline.
