The thing most people don’t understand is Arkham is NOT a prison it is an Mental Health Hospital or and Asylum. They don’t have the authority to execute anyone. Joker is a master manipulator he gets RELEASED because he makes the doctors and staff believe he is rehabilitated or cured of his mental illness(es). You can technically escape but he doesn’t need to. Because they legally can’t hold him against his will because that would be false imprisonment or kidnapping.don’t get me wrong he absolutely deserves the death penalty but since Batman keeps bringing him to the asylum he won’t ever be charged due to the Inanity Plea

If joker was real and only the joker there is no one that could stop him, his pain tolerance is inhuman, his intelligence he can trick the worlds greatest detective and can go blow for blow with him despite not having any formal combat training and he is a master chemist that can create poisons that would make mustard gas look like pure oxygen

So I do agree that irl the joker would face the death penalty, but one thing that was said wrong is Arkham Asylum is not a jail. Joker wasn't always breaking out of a jail. Yes they did lock him in prisons and jail cells, but he mostly broke out of Arkham Asylum which is a mental health institute. Yes it is shown to look like a prison or jail, but it is a mental health institute.
