If your evidence is concrete direct not circumstantial trial should never be difficult it’s straight forward of course depending on the case

@Sal Mac13:The issue that you're describing is one that can happen with any witness. That is why it is very important not to ask open ended questions, or ask a witness a question you don't have evidence to prove. And the result of the guilty verdict is oftentimes no different then the offer that was made to avoid trial and the reason being is that an individual cannot be sentenced to more than the mid term without proof of facts in aggravation. If you want to avoid the whole trial thing that's the most you get out of avoiding it except in certain cases like a murder case!!

honestly if you're gonna lose to a jury, you're probably gonna lose to the bench. you'd have a higher chance convincing someone out of a group, than just 1 specific person

I often talk with clients about the things at trial we can’t control. We can’t control what the judge or jury had for lunch, for example, and whether that lunch caused them and upset stomach such that in the afternoon, they aren’t listening closely because their stomach hurts. It’s a real risk that’s hard to quantify.

😂 This is something some lay people just don't understand. A while back I encountered another user that was complaining about how his attorney screwed him over by convincing him to take a plea deal he now regrets. I asked him to describe the case, what he was up against at trial and.... Yeah, taking the case to trial stood a substantial risk of a much worse sentence. Some law people just don't understand how evidence stacks up. Just because there is one piece of evidence that supports you doesn't mean the judge or jury will ignore the 13 other pieces that say you're wrong.

Clients are rarely happy at trial even when they win. I prefer a mediation agreement every day of the week.

You never know if you’re going to get a juror who doesn’t want to follow the law.
