Because New York loves to have their hand in every single pot you have to be New York licensed to drive Uber in New York City in or out of the city, so the driver is definitely based in New York if they picked you up in New York, meaning they have to go back into the city. She will not get charged that crossing on the inbound only the outbound since they have to return.
