Former prosecutor here who agrees hung jury should equal not guilty. There was obviously reasonable doubt if the jury could not decide and I very much think it’s not fair to put the defendant through another trial.

Yeah well if the state can’t get to beyond a reasonable doubt to get the jury to convict then ¯\_(ツ)_/¯. I often point to an example I find contentious, OJ Simpson. Do I think he killed his wife? Yeah. Did the prosecution prove that beyond a reasonable doubt? Nope.

How about this: if a jury is hung then it’s a mistrial except when the majority votes not guilty, then it’s a not guilty verdict.

I said on threads that deadlocked should mean NG because one person having reasonable doubt means there IS reasonable doubt and I got a bunch of people like “what if someone is really dumb” like it’s not that there’s an IQ test during jury selection but I’m still not concerned.

I literally said this on another video. If there's a hung jury mistrial, the judge should be able to rule not guilty and rule with prejudice so the prosecution has to present new evidence and different charges. Because clearly there's doubt about the guilt of the defendant.

It’s not charged to your client. They get a do over or a more favorable plea depending on the prosecutor. It’s not as though jurors can’t be unreasonable. Someone may have lied or underplayed a prejudice. That means a rapist, murder, pick your heinous crime, goes free?
