We just closed on a house where the seller lied on the disclosure and inspection didn’t catch visible black mold or the leaking pipes feeding it

Most of my clients won’t but if I ever buy again I’ll have a mold inspection by a mold dog. Mold is a pain in the butt to deal with and super expensive. I don’t think our sellers knew tho, as they kept everything else in excellent condition.

We just backed out of a deal after our inspector found the entire house had active knob and tube wiring throughout that wasn’t disclosed on the seller’s disclosure. We brought it to their attention and they said “we were not aware. We thought it was fixed”. Whether they didn’t know or thought it was fixed, it wasn’t disclosed that any electrical work was done and they specifically marked that it wasn’t k&t electrical. Our inspector also noted that it looked like someone had tried to hide damage to the garage roof and moisture in the walls of the sunroom so there were plenty of reasons to back out.

Yup lol the house we just bought they answered everything was fine. Nooo mam it was not lol. thankful it wasn’t terrible but huge leak behind the wall in laundry room that they tried to cover up with a piece of dry wall- carpet was peed on so bad from dogs but so much furniture (hoarders) was covering it that we couldnt really tell- we had to TREAT THE CONCRETE underneath it was so bad. Also baseboards were all taped up and were also thrashed completely. Our realtor made us write down that my husband vaped in the garage on our disclosures 😂 we were so honest about everything on our side.

My thing is, I’d never trust a sellers disclosure. If you see smoke you see fire, so if they say “small leak by basement, fixed no issues since” I AM DRAGGING THE INSPECTOR THERE AND ALL AROUND THE FOUNDATION to find anything! 🤣🤣 But we had to fill out a disclosure form and did it to the best of our ability but we only owned it for 4 years so like, will something pop up we had no idea about?? Possibly?? But if we never sought mediation of an unknown problem I don’t think we can be held liable right?

I just closed on my home last May. The seller lied on his disclosure about numerous things and we had the paper trail that he knew (repair quotes, etc). We settled out of court, with lawyers, fir $25k

Moved into a house and seller didn’t disclose mold around spare bedroom window. When we went to the open house, we remember seeing a plug in air freshener. But just in that room! Then not even in the house 2 months, we kept having sewer back ups in the first floor bathroom. When plumbers put a camera in the pipe, they told us that the crack in that pipe was old, and that the previous owners had to know about it!! Because both problem items were not disclosed. Also, not disclosed was flood insurance they had been paying yearly, due to living behind conservative land. Looking for a good real estate lawyer to see what we can do to the seller and the sellers agent who is their friend!!!!

I backed out of a house because the seller lied about "new" insulation. They just taped foam boards to the windows and hit it with curtains. Also the inspector i paid for couldn't access everything cause seller bolted it shut or didn't move stuff out of the way so it was really annoying like I dont get a partial refund for that because its not the inspector fault.

This is just one of those super fun things. Long story short bought a house six years ago a new roof was in the process of being put on it. Fast-forward now we’re having roof issues, the structural beam that all the rafters sit on and some of the rafters in the vaulted ceiling have deteriorated due to lack of ventilation that was never disclosed to us by the seller, my realtor, their realtor or our inspector. So we’re looking at about $50,000 to fix our roof.

I will add, as a seller, don't listen to your agent if they recommend omitting or indicate you are not required to report structural repairs on your disclosure. We had a contract fall through on our 4 year old house because our agent explicitly instructed us to not disclose a structural repair to a load bearing wall that was completed by the original builder when we discovered an issue about a year after we had moved in. This mistake cost us so much because the 2001 dot.com crash occured right after that, and the housing market in our area, especially for larger hones, dropped practically overnight. Of course, after the contract fell through, we insisted our agent revise our disclosure to include the repair. We eventually sold the house, but at a price so low that it barely covered our remaining mortgage. The worst part is that the repair was solid, so the first potential buyer would have completed the deal if we had included the repair in our original seller's disclosure, but he chose to cancel the contract specifically because he felt we had not been truthful and could not be trusted. We should have trusted our instincts and included the repair in the original disclosure regardlessof our agent's instructions. Unfortunately, the omission was our agent's fault, but we paid the price, literally.

Depends on the state, here if the property is owned by foreign party and it's not their main home they are not required to disclose, same if it's a vacation home. 🫠

we were completely floored when the sellers who lied about having an unusable fireplace and their house was on TOP of a 13' easement for the city and lost tens of thousands of dollars to us in legal fees... immediately relisted the house with the SAME realtor. who kept sauing, "i dont understand what the big deal is!"

Here’s the thing you have to have proof that the sellers lied on the disclosure. My husband and II purchased a house before becoming a real estate agent. A few weeks into our house. The house flooded through one of the bedrooms. The neighbors knew but weren’t a reliable source and years later, the son who lived in this house told us that the house flooded multiple times. We went to an attorney and they wanted a $10,000 upfront retainer fee when we could fix the problem for way less than that. But now that I am a real estate agent I tell all my clients to talk to the neighbors about that specific property they want to purchase.
