The lawyer f*cked up, you ask for a will to be made before separation but don't make sure the will was made and signed and in your possession before finalizing stuff? Also a will can be changed at any time, so that was a never a guarantee of anything. That's an awful lawyer 🤦♀️

When you buy a house together they have an inheritor clause for who gets the house if you pass, so even without the will if he put the wife’s name in that clause she should still get the house.

This happened to my coworker. Her toxic alcoholic husband who drank his liver into organ failure was refusing to divorce her. Luckily, his pension, retirement, house, and FAA life insurance was all still benefiting her and their kids. His parents were gracious enough to not fight her for it because they knew what he put her through. She earned it.

If they made a will a condition of the divorce settlement why wouldn’t that be verified prior to the divorce being finalized. Also wouldn’t the divorce settlement language help establish his intent for the house?
