Everyone doesn’t understand how an Appeal works in Texas. KA isn’t guaranteed a new trial even if his Appeal is upheld. The lady here doesn’t explain it well. An Appeal is Filed. Means nothing. It means nothing because an Appeal isn’t a trial, it’s a Hearing. Heard by 3 Judges. For Texas, no new evidence is used in the Appeal. The Appeal will not pronounce KA Innocent or Guilty. A Jury convicted KA, only a Jury can now find KA Innocent. The Appellant Court will simply Overturn the Conviction, kick the case back to District Court. Texas can THEN try him again if it wants too. The Hearing is only concerned about Process & Procedure of the trial. There will be testimony. Not about Guilt or Innocence. No evidence of Guilt or Innocence will be discussed. It’s a Hearing. Not a retrial.

Around 80% get denied upon filing appeal with only 5% getting a hearing and around 2% of appeals in Texas are successful which usually gets sent back to district court
