im annoyed bc technically the jury IS NOT doing their jobs correctly bc when theres ANY reasonable doubt given, which EVERY SINGLE DAY of the trial showed nothing but reasonable doubt, anyways, when there is reasonable doubt then that means they should be giving a NOT GUILTY verdict 😑

Look into Massachusetts Rule of Criminal Procedure 25. If the jury remains deadlocked and is discharged, the defense may ask the judge for a required finding of not guilty based on legally insufficient evidence of criminal responsibility. It’s rare and definitely not automatic—but it is another possible outcome besides a retrial.

My dad was murdered in 2007. We went through three murder trials. It was very mentally draining. The first time it was a miss trial, the second time it was a Hung jury & and the third time he was found not guilty. It is still not solved. So many unanswered questions. I really do not have closure. There were so many things that were missed and botched up in my father‘s case. I’ve really been glued to this case and see how there are so many things that do not add up. I really like following you and your commentary and opinion on the trial.

I feel like he put extra emphasis on the common wealth and reasonable doubt, he’s trying to get them to actually see that the EVIDENCE that they provided, regardless of their personal feelings, does not prove guilt. I don’t understand how they can’t see it.

There is 1 more option and we know big red will ask for it but it’s rare for a judge to grant it… he can ask for rule 25 for the final time! He’s used it twice already and it’s been denied but I have my fingers crossed that the judge would grant it!!!!

One thing giving me a little peace no matter what the jury decides is remembering that Lindsay’s civil malpractice case is still going forward. Civil discovery can bring out sworn depositions, medical records, communications, documents, and other evidence that either wasn’t investigated or wasn’t presented in the murder trial. We’ve already seen how many questions were left unanswered—the untested residue in the cup, medications and an Apple Watch apparently missed in the bedside drawer, the fingernail swabs whose results we haven’t heard about, questions about how thoroughly the scene was processed, etc. So even if the jury finds Lindsay criminally responsible, this verdict doesn’t necessarily have to be the end of everything. If the civil case uncovers genuinely new and significant evidence that contradicts the criminal case—including evidence that implicated Patrick or another person—her attorneys could potentially use it to seek a re-examination of her conviction/new trial. Obviously, there is currently no established evidence that Patrick killed the children, and I don’t want to turn unanswered questions into accusations. But civil discovery gives another opportunity for facts to come out under oath and records to be examined. That’s the silver lining I’m holding onto if the verdict doesn’t go the way I’m hoping. ❤️
