Smith v Hughes (explained simply). This case says that if you make a mistake about what you're buying, that's usually your problem – not the seller's. Here's what happened. Hughes had assumed they were old oats – the only kind his racehorses could eat. They were new oats. Smith had never said the oats were old. Age wasn't mentioned at all. Hughes refused to pay. He argued that he'd made a mistake, and that Smith must have known he thought they were old oats. The court disagreed. Smith knowing about the mistake wasn't enough. He hadn't caused it. The rule: if you agree to a deal, you're bound by what a reasonable person would think you agreed to. Your private assumptions don't count unless the other side created them or agreed to them as a term of the contract. It's not the seller's job to rescue you from your own mistake. If the age mattered to you, you should have asked. The legal principle is called
