The nine women and three men had deliberated about 30 hours when they left the courthouse on Wednesday. Judge William Sullivan asked them the questions he asks each morning before they went to the jury room. "First question, as you all know: As you all know, has any member of the jury read, seen, heard, or heard or overheard anything from any source that would affect your ability to be a fair and impartial juror?" "Lastly, is there any other serious matter of concern bearing on your service as a juror in this case that would that anybody needs to bring to my attention?" Jurors have twice said they can't reach unanimous agreement. The judge told them to continue deliberating after the first deadlock note on Tuesday morning, then read them a formal instruction on Wednesday that told to reconsider their views. Massachusetts is among states that allow the instruction under Allen v. United States, an 1896 U.S. Supreme Court decision that says a court can instruct deadlocked jurors to reexamine their views. Massachusetts refers to it as a Tuey-Rodriguez charge, referring to state caselaw. Jurors heard 22 days of testimony after opening statements on July 27. They are not sequestered. A 56-year-old woman was arrested on Tuesday after police saw her car in a restricted parking lot and found deleted photos on her phone of jurors leaving the courthouse. The jurors apparently are unaware of the photos and arrest; the judge questioned them individually Wednesday morning but did not tell them about the photos or Light's arrest. Clancy, 36, was on maternity leave from her job as a labor and delivery nurse when she strangled 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan at their home in Duxbury, Massachusetts, on Jan. 24, 2023. She is charged with three counts of murder; jurors must decide if it's premeditated. Jurors can consider manslaughter as a lesser included offense to murder. #law #crime #court
