The defense attorney is arguing because there’s 11 jurors that have determined that she’s not guilty and one person who is willing to say that she is guilty. The defense attorney is alleging that the one drawer is not following the judges guidelines for reasonable doubt and feels that if that juror is removed a replacement drawer would find reasonable doubt and thus find her not guilty. If a miss trial is declared then it’s as if the trial never happened and it has to be resumed all over again with a new jury, possibly new judge, and maybe this new jury would not be so considerate towards the defendant. Personally, the single juror meets to hold their ground and if a miss trial is declared then do it all over again
