I was a juror on a murder case when I was 22. An elderly man said he couldn’t hear most of the testimony. I read every page where he “missed” stuff. I took a week and a half too. Why was i so determined? The victim’s 8 yo son testified. I did not want him traumatized any further. The senior man just needed to be sure and I understand. It was only guilt or innocence being argued. He didn’t want a death penalty possibility if he was unsure. I would do it again. Kindness, listening and patience prevailed.

The defense can claim the juror is failing to adhere to the law. The judge can agree and intervene or they can not and advise on the laws and what the instructions are and if they still don’t agree with your opinion or the defense’s opinion that doesn’t mean they didn’t follow the law. The defense can make the claims they are making without any proof. The judge simply said the jurors asked a question, not that the person wasn’t following the law. The judge said he isn’t going to side with the 11 over the 1 or the 1 over the 11. If they can’t agree then they can’t agree. They all know she did it and committed the act. So if they are deadlocked on a verdict then they are either she’s insane or guilty of premeditated murder. Have you ever seen 12 angry men? Think of that but in the opposite. Just because 11 think they are right doesn’t mean the 1 is wrong.
