Massachusetts law requires a unanimous jury verdict in a criminal case. A mistrial means she has not been Guilty or not Guilty. It is up to the prosecution if they will retry the case or offer her a plea bargain or drop the charges.

after today, it came to light that there is one juror who was not following the judge's orders and now they're looking to replace said juror.

It’s a hung jury, very doubtful that will change, so it will be declared a mistrial. It’s up to the DA to recharge her, which they will likely go to a second trial because of the enormity of the crimes.

Mistrial if they come back again deadlocked. Then Red can file a Rule 25 motion to ask to get the case dismissed (highly unlikely judge will grant it), then DA can retry the case again with 1 year. He could reduce charge to murder 2 and request bench trial with no jurors next time.

Judge gets final say. He can also only send the jury back one more time. If they are still deadlocked after that, mistrial from my understanding.

Jury nullification should lead to a mistrial and then Double jeopardy laws will protect her. They can try to charge her with something else.

I think you’re right. The judge has the last say, but they should’ve skipped the jury altogether and took a direct verdict from the judge.

The judge cannot interfere with one juror. They were selected. Sometimes jurors do change their minds - but they should not be tortured for whatever conclusion they have come to.

I believe MA law states the judge can only redirect a jury twice.

Because one juror has a problem with reasonable doubt, there are a couple of ways to look at reasonable doubt she didn’t do it or reasonable doubt that she had malice doing this. When the judge explained this today it was very confusing I can’t imagine being a juror .

well the right thing would be to do is to have a mistrial but this one drawer is going to be cursed in the making a call that they don't want to make that's interference with a juror

There is a method where the judge could set aside a jury verdict and rule himself. 🤷♀️
