at the risk of sounding woo-woo, I firmly believe God spared her life for this moment. she isn't guilty, and I hope she knows it. I don't understand how the jury is taking this long for something that seems so incredibly obvious!

I think you are right. My guess is that the holdout has reasonable doubt but is getting hung up on “but she admitted it” nonsense rather than following the judge’s instructions regarding her innocence until proven guilty. The jury is a microcosm of the internet and there have been SO many people that get so stuck on this. Further proof that a bifurcated trial would have been more appropriate.

Couldn’t agree more. I think it’s 100% a man holding out on not guilty. And if he is, the whole thing is going to go to mistrial if he doesn’t change his god damn mind. At which point, she’ll never get convicted because there’s no way prosecution can come up with more evidence to win a case (BECASE THERE IS NO MORE EVIDENCE) and it would be impossible to find an impartial jury. SO JUST FOLD, MY GUY.

i have been seeing soo many people like well we don’t know if it’s not guilty due to insanity or whatever and i’m like but isn’t the reasonable doubt rule for acquittal?? like any reasonable would equal that ?? people aren’t using their common sense lol

I’m always so happy to hear your thoughts! The judge emphasized the reasonable doubt so hard in my opinion. I also felt like he emphasized the word acquittal. It could just be my own wishful thinking.

In the UK, they look for a unanimous verdict but will accept a majority rule, 11-1 or 10-2. Do you think this should be an option in the future? Unanimous verdict allows for absolute outliers, people who can not look past their own belief, feeling, emotion, or bias. Here, the law says if 11 jurors can agree on a verdict, then we can infer the 12 juror has an unreasonable position, we do not ask that juror to change their mind, we accept the majority rule.

I’m in the uk so 5 hours in front of the trial I have to wait till 2 pm every day before they get to court. It’s 8 .15 am now and I don’t think I can stand it I’m praying this is a total acquittal

I think the one juror acknowledges reasonable doubt but also maintains they think the commonwealth proved probability that she committed the crime, so they're not wanting to follow the law that reasonable doubt leads to acquittal. That's why judge Sullivan made some very specific references to reasonable doubt, presumption of innocence, acquittal, and how a "strong probability" isn't enough to say she's guilty.

Also, am i correct here - the person had to have said "yeah i have doubts but im not changing my verdict" aka breaking the law/instruction etc - otherwise they couldnt have "outted" a specific juror to the judge?

I found the judges response to deny Reds motion, interesting. His reasoning was he can't side with the 1, nor can he side with the 11. Which I understand, and fully agree with - however, if the 1 is in fact REFUSING to acknowledge/accept the law, Reds motion to replace that juror should be granted. I think he re read the law on reasonable doubt to say 'I'm giving the 1 the benefit of doubt that they aren't REFUSING the law, they just don't UNDERSTAND it, so here it is again' I think if the jurors come back today and maintain the 1 is still denying the law, Red will again request replacement of the 1, and the judge will agree. But I worry the risk of a hung jury and mistrial is even bigger now. If the 11 don't stand against/prove the 1 is actually just being a deliberately obstructive.

Agree 100%. Bc if you have 12 jurors that agree that there is RD on element #1 (commission of the crimes) and all 12 apply the law properly (vote “not guilty”), there’s no deliberation necessary on element #2 (criminal responsibility). I think the 1 juror at issue wants to deliberate on element #2 and reach an NGRI verdict. But that isn’t possible if you have RD and apply the law properly on element 1. So even though they acknowledge there is RD on element 1, they refuse to apply the law properly.
