The judge specifically gave the very first set of instructions either guilty or NOT GUILTY. She pleaded NOT GUILTY. If it means not guilty without criminal intent, that’s fine too, but she literally has the option for not guilty.

I’m confused though. Isn’t reasonable doubt applied to every issue, including NGRI? Could one juror believe the state failed to disprove insanity beyond a reasonable doubt, but still refuse NGRI because they personally think anyone who kills their children should be imprisoned? How could she be acquitted entirely if the above applies? Genuine question. I’m not a lawyer.

as a defense attorney, this is completely wrong. Now I will stay upfront that I might be misunderstanding your use of acquittal. But the reasonable doubt could easily apply to her being found guilty, but not criminally liable, which would not be the same as an acquit.

Or the 11 are voting a certain way and the 1 doesn’t agree. So the 11 don’t understand why that person isn’t agreeing with them, which in turn is allowed.
