The Biden administration’s 2022 public charge regulation is being rescinded, giving immigration officers broader discretion to look at the totality of your circumstances—including things like age, health, finances, family situation, education, skills and certain public benefits. But public charge does NOT mean, “You received a government benefit, so your green card is denied.” Immigration law is rarely that simple. Many immigrants are exempt from public charge entirely, and even benefits received by your children do not automatically make you inadmissible. We’re also seeing the State Department retrain consular officers around the world on public charge screening, so this is clearly becoming a bigger part of immigration adjudications. What should you do? Don’t panic, don’t cancel benefits your family is legally entitled to because Facebook scared you, and don’t file an immigration case with a “let’s see what happens” strategy.
