The dispute intensified Friday before the jury again reported it was deadlocked and Sullivan ruled that a mistrial should be declared. The defense then sought extraordinary emergency relief from the state’s highest court under Chapter 211, Section 3, putting that ruling on hold while the matter goes before a single SJC justice. Clancy does not deny strangling 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan in 2023. Her defense argues postpartum psychosis left her not criminally responsible, while prosecutors contend she remained aware of her actions and understood right from wrong.
