Nearly 40 hours into deliberations across seven days, the jury sent a note stating, “It is with a heavy heart we are unable to come to a unanimous decision” and “will not be able to,” prompting the judge to state that Massachusetts case law required him to declare a mistrial. The impasse follows a dispute where defense attorney Kevin Reddington sought the removal of an apparent lone holdout juror who reportedly acknowledged doubt but refused to vote for acquittal. Judge William Sullivan refused to dismiss the juror, maintaining that the court could not improperly intervene in jury deliberations. Reddington asked the judge to send the jury back or poll them regarding whether any partial verdicts were reached (citing precedent from the Karen Read trial), both of which the prosecution opposed. Judge Sullivan then granted the defense a one-hour window to seek an emergency stay from a single justice of the Massachusetts Supreme Judicial Court.
