Had a similar issue when I got a divorce. MY VA loan. When I called the loan company to get his name off the deed they assumed he was the Veteran and got in my face about it. I had to insist they look at the paperwork. They didn’t even apologize. I wanted to murder someone.

If you did the loan with your VA benefits - it actually should have listed your name first (VA rule) so that right there was wrong. They should have also asked you how you wanted the vesting… typically it would have been your name, his name, wife and husband as joint tentants (or tenants in common) You can ask the title company to fox the vesting if it bugs you. Might cost you a small fee (your loan officer should pay for it bc it’s their job to make sure that’s correct when docs go out) But definitely check that first before you sign next time.

I would file paperwork to have the deed corrected to identify husband and wife! while there is a legal basis for the deed identifying the legal relationship- only identifying you as the wife is the antiquated part of this!!

I live In NC. If you bought a House before you got married, and then Married your husband, you would need him to sign a paper to allow you to sell it, even though it was your house before you got married. Its a NC thing. The laws here are so crazy.

Take it to a lawyer and ask the mortgage company to correct it. Or you can form an LLC of “Jane Doe and John Doe”, equal partners and ownership with right of survivorship.

they can try to justify it all they want... it's just plain wrong. I had everything in my name and added husband. After the divorce, all my deposits were in his name. I had to close bank accounts cuz they wouldn't remove him. I had to change banks to keep them from taking my $ to cover his bad checks on his own account. I even had to change my insurance companies to remove him.

From a legal perspective, identifying a woman as a man's wife signifies that a legally recognized marriage exists between them, granting specific rights, protections, and obligations under the law. It shows that you are not just some random person and we have the special rights and privileges as a spouse. If your name was listed first the same would go for him.
