I don’t think it’s a red flag but as you say I think there should be a clause in there saying if you get married and have children it becomes a marital asset and goes to 50/50

This is basically my partner and I. We’ve got equal deposits but I’m being gifted 20k to top it up, so I want that protected just incase we split (not likely but you never know.) I think we’re getting a declaration of trust drawn up.

This is exactly what me and my partner did, it seemed the fairest and most sensible approach. When we signed the document the lawyers said when we get married it would be null in any divorce proceeding

It’s financially responsible. If he has that much more as a deposit, technically he would own more of the house. They wouldn’t be getting the house they’re getting without his contribution. Everything else is divided equally. It’s very much a green flag. He should get back his original investment if the worst happens. The point is, is can happen to anyone, so why not be protected?

I have a deed of trust with my partner - I was under the impression from our solicitors that if we got married the declaration of trust would still be in place and we wouldn’t need a prenup?!

I bought my house before I was married and my then fiancé signed away any interest in the property. He didn’t care about the money at all. Bing reasonable and rational about money makes all the difference in successful relationships.
