This scene was a motion to suppress evidence. It was a handgun found on Raymond Reddington through what he was arguing was an illegal pat-down search. He had an immunity agreement with the Federal government but he was carrying a weapon with the serial number scratched off...a serious Federal crime. So, hes arguing the firearm seized during the search is poisoned fruit of an illegal search

In Germany, the judge stipulates this: "Sometimes there is room for manoeuvre from our legal code. Lifelong means only 15 years for us, but then it may be that goes to death. Let me refer to what you're pointing out. Raymond was not filling for motion to suppress. He know he's been caught at that point, being that his a criminal. Raymond was aiming to dig was the fact that someone rated him out. That's why he was making the officer know he could never have arrested him based on mere investigations.
