@meghannmcuniff: The leader of the office that is prosecuting Lindsay Clancy said after the mistrial today that her murder case is "not about the healthcare system or about how women are treated in it." "Or what diagnoses there are in the DSM, or what there are not," said Tim Cruz, the elected district attorney in Plymouth County, Massachusetts, referring to the Diagnostic and Statistical Manual of Mental Disorders. Testimony in trial discussed an effort to add postpartum psychosis as a separate, standalone diagnosis. "Those are all important issues. They stir up emotion, and sometimes they stir up anger. This case, however, was about Lindsay Clancy, and what she did on January 24, 2023, and the cruel and calculated killing of three innocents," said Cruz, who has been Plymouth County's top prosecutor since 2001. "I understand that postpartum depression has impacted the lives of countless women and their families, and I sympathize with their struggles. The investigation into these heinous killings, however, did not establish that they were caused by such depression, and based upon that assessment, it was determined that the charges of first-degree murder were warranted and appropriate in these circumstances." "I have led the Plymouth District Attorney's Office for a long time now, and I have never been swayed to act a certain way or make certain decisions based upon public sentiment." Cruz has not said if Clancy will be retried. A status conference is scheduled for Sept. 29 in Judge William Sullivan's courtroom. After court today, the 36-year-old former labor and delivery nurse was taken to a psychiatric facility where she's been staying. She's still charged with three counts of murder for strangling 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan on Jan. 24, 2023. The jury deliberated 38 hours over 6 1/2 days before the forewoman sent a note today that said, "It is with a heavy heart that we report we are unable to come to a unanimous decision, and will not be able to." They'd twice previously said thy were deadlocked and complained that a single juror was not following the law on reasonable doubt. #law #crime #court
