UPDATE: Truck Driver Sentenced to 20 Days for Killing Lima Father and 11-Year-Old Son on I-75; ICE Waiting to Take Driver When Sentence Ends LIMA, OHIO — A Florida truck driver who plowed into backed-up traffic on Interstate 75 and killed a Lima father and his 11-year-old son has been sentenced to 20 days in jail after pleading no contest to misdemeanor charges, with ICE waiting to take him into custody when his sentence is complete. Yvio Michel, 53, of Boynton Beach, Florida, was driving a Great Dane semi-truck northbound on I-75 near the Cridersville exit in Fort Shawnee on February 28 when he failed to maintain adequate following distance as he approached congested traffic and struck four passenger vehicles and another semi-truck around 8:15 p.m. Amanda Gipson, 45, of Lima, was driving a 2015 Buick Enclave with her husband Hurshel Gipson, 52, and their son Michael Gipson, 11, as passengers. Both Hurshel and Michael were pronounced dead at the scene. Amanda was transported to Mercy Health St. Rita's Medical Center in Lima with serious injuries. One other victim was transported with serious injuries and two others with non-life-threatening injuries. Michel suffered non-life-threatening injuries and was treated at Lima Memorial Hospital. The crash closed I-75 for five hours. Lima City Schools described Michael as a beloved North Middle School student and friend who had recently received statewide recognition as a winner of the R.A. Horn Award. The school announced counseling services for students and staff following his death. "Michael was a beloved student and friend who will be missed by his classmates, teachers and entire school community," the district said. "We ask that you keep the Gipson family and Michael's Spartan family in your thoughts and prayers." Michel pleaded no contest Wednesday in Lima Municipal Court to negligent homicide and vehicular manslaughter. Judge Tammie K. Hursh found him guilty on both counts and ordered two mandatory 10-day sentences to run consecutively for a total of 20 days in the Allen County Jail. Michel is scheduled to complete his sentence September 21. On the negligent homicide conviction he received 90 days with 80 suspended and 10 mandatory plus a $500 fine. On vehicular manslaughter he received 180 days with 170 suspended and 10 mandatory to run consecutively. His license was suspended for two years through September 2, 2028, six points were assessed, and he was ordered to pay an additional $500 fine plus court costs. As part of the plea agreement prosecutors dismissed a second negligent homicide count, a second vehicular manslaughter charge, and a charge of failing to maintain assured clear distance ahead. Michel had initially pleaded not guilty to all five charges. Allen County Jail officials confirmed ICE has placed a detainer on Michel. During his March arraignment his attorney revealed Michel is a Haitian national seeking asylum who was living in the country illegally. ICE will be notified when he completes his sentence.
