Family law paralegal here! Neverrrr ROFR for high conflict. The high conflict parent will not only NOT offer it to you, but they will use it to their advantage to prevent kids from going to summer camp, grandparents houses, aunts and uncles, even SLEEPOVERS WITH FRIENDS because “you’re not watching them” 🙄🙄🙄 then they will constantly bring it up to frame you as an uninvolved parent. Super fun!!

Former custody attorney and now-divorcee here, single parenting in a high-conflict/DV situation. The ONLY time I recommend ROFR is in a situation like mine - I have sole legal and physical custody, and my kids’ dad only has visitation for 5 hrs/month. In our case, ROFR makes sense - if he can’t prioritize seeing them for that 0.007% of the time, and would rather leave them with someone else, then it makes more sense for them to just stay home and not have their lives disrupted. Will he follow the order? Of course not. But if the kids share that they were left with someone else, I can file a contempt motion and have his visitation time cut further, to protect them further. In almost any other case, ROFR just gives controlling/abusive/high-conflict coparents another avenue for power and control games.

It isn’t enforceable. We never know until after. They do it on purpose to bother us. My kids are at his parents more than with him. ‘Grand parents are important’ so are fathers! He should parent! Yet here we are and my kids are old enough to know now.
