This was in 2017. He was on a walking path, train track didn’t have any barriers or signs and he didn’t realize he was on a working train track. Train never sounded its horn/whistle and he tried to get out of the way but couldn’t move fast enough

The 911 operator is trained to ask questions and be calm. This helps the caller stay calm. She is not being cold and stupid.

He lost the lawsuit, then appealed, and lost again. Court based decision on following. 1) Jacob was trespassing. Since he was trespassing, the train could only be held liable if they were extremely negligent. 2) Conductors sounded the horn when first saw Jacob. Since they sounded the horn, they couldn’t have done much more. 3) Jacob knew it was an active train station. 4) Jacob admitted there was room to walk alongside track but he walked on track. 5) He was wearing noise cancelling earbuds.
